General Terms and Conditions

magazinemarketplace.co.uk is owned and maintained by or on behalf or B Hannah Ltd and its group companies ("B Hannah" or "we" or "us")

Please read the following carefully. Your use of the magazinemarketplace.co.uk web site ("Magazine Marketplace") and purchase of the products (or services) ("Products") on it means that you agree to these terms and conditions ("Terms").

By accessing magazinemarketplace.co.uk you agree to be bound by the following terms and conditions ("Terms") and our privacy policy. If you do not agree with these Terms, you should leave magazinemarketplace.co.uk immediately.

Shopping with Magazine Marketplace

When you place an Order for a Product online ("Order") you are offering to buy it for the price stated, subject to these Terms.

When you place your Order online we will send you an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your Order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your Order. Once we have sent the confirmation email we will then check availability and contact you with a further email. If the Product is available and the details of the Order are correct, this email will be deemed an acceptance and will specify delivery details and confirm the price of the Products purchased. If the Product is not available we will also let you know by email.

Magazine Marketplace may cancel any sale and not supply Products if it is reasonable to do so and may change or discontinue the availability of Products at any time at its sole discretion. If an Order is cancelled, any payment made for the Products will be refunded in full. This does not affect your Statutory Rights.

All new Orders are deemed separate and each is treated individually.

If you purchase a subscription, you may cancel it within 30 days of purchase (the “Initial Period") provided you give us written notice. If you want to cancel your subscription within the Initial Period you must write to us at B Hannah Ltd, 21-24 Bruges Place, Randolph Street, London, NW1 0TF supplying your name, address, subscription number (if possible) and the magazine name. If we receive your written notice within the Initial Period we will refund you for all unmailed issues of the magazine. We will only cancel subscriptions within the Initial Period.

Subscriptions to the Celebrity Angels series will start from the next magazine out in the series (unless requested to start from the current issue), so please allow up to two months for the first publication to arrive.

We hope that all the magazines you purchase will be of good quality. If you receive a magazine in a damaged condition you should return it to B Hannah Ltd, 21-24 Bruges Place, Randolph Street, London, NW1 0TF along with a request for a replacement. You must provide your name, address and order number (if possible).

In order to make a purchase through magazinemarketplace.co.uk you will need to supply us with certain personal information about yourself. We will only use this information in accordance with our privacy policy.

Price and payment

The price in UK pounds for each Product is shown on Magazine Marketplace, there is no V.A.T payable on magazines.

We always try to make sure that the prices on Magazine Marketplace are accurate but errors may occur. If we discover an error in pricing of the Products in your Order we will inform you as soon as possible using the contact details you supply us with. We will then give you the option of reconfirming your Order at the correct price or cancelling it. (If we are unable to reach you we will treat the Order as cancelled). If an Order is cancelled, any payment made for the Products will be refunded in full.

You will be notified of the delivery costs automatically before you complete your purchase.

You must pay for your Order before it is delivered and you can do so by using Pay Pal Express checkout.

Availability

We try to keep Magazine Marketplace as up to date as possible but cannot guarantee that a particular Product will always be available. If we can't supply a Product you will not be charged for it and we will refund or re-credit your account with the amount debited by us.

All offers are available while stocks last. If we are unable to supply a Product you have Ordered, we will notify you as soon as we can after receiving your Order. If this happens, you may cancel your Order and we will refund you the money you have paid for it.

Delivery

Magazine Marketplace delivers only to destinations within the UK.

You will be notified of the delivery costs automatically before you submit your credit card details.

Orders are despatched either by Royal Mail or by courier. Our couriers require a signature and operate between 9am and 5pm on weekdays, so please specify an address where someone will be able to sign for your Order between these hours.

We will make every effort to deliver within the time stated on Magazine Marketplace but we will not be liable for any loss caused to you by late delivery.

If the Products are not delivered within the estimated delivery time which we quote, please contact us by email and we will try and ensure that you receive your Order, as quickly as possible, or if you wish you may cancel your Order and we will refund the money you have paid. Please note that while items sent by Royal Mail usually arrive within 2-4 days, Royal Mail stipulate that only items still not delivered after 15 working days can be officially classified as lost.

When placing Orders with Magazine Marketplace please allow sufficient time to prevent any loss or disappointment resulting from the delivery time as Magazine Marketplace cannot be responsible for this.

This does not affect your statutory rights as a consumer.

Advertisers and third parties

We accept no responsibility for any adverts or links to websites operated by third parties (“Third Party Websites") on magazinemarketplace.co.uk. If you agree to purchase goods and/or services from any third party who advertises on or is linked to on magazinemarketplace.co.uk, you do so at your own risk. Magazine Marketplace does not have any influence or control over any such Third Party Websites and, unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents.

Rules relating to conduct

magazinemarketplace.co.uk is made available for your own, personal use. magazinemarketplace.co.uk must not be used for any commercial purpose whatsoever or for any illegal or unauthorised purpose. When you use magazinemarketplace.co.uk you must comply with all applicable UK laws and with any applicable international laws, including the local laws in your country of residence (together referred to as “Applicable Laws").

You agree to indemnify B Hannah and its group companies in full and on demand from and against any loss, damage, costs or expenses which they may suffer or incur directly or indirectly as a result of your use of magazinemarketplace.co.uk otherwise than in accordance with these Terms or Applicable Laws.

Copyright and Trade Marks

Magazine Marketplace does not give you any right or interest in any copyright or intellectual property rights in any Product nor the right to copy them.

The copyright in Magazine Marketplace and the content of all the software, web site and pages relating to the Magazine Marketplace web site is owned by, or licensed to Magazine Marketplace, unless otherwise specified and may not be used, copied or altered without our express consent.

Copyright extends to the design, look and feel of Magazine Marketplace, all photographs on it and its marketing materials.

You may use Magazine Marketplace for private and personal non-commercial use only - i.e. to view, copy and print portions of firebox.com for the sole purpose of placing Orders. The materials on Magazine Marketplace may not be used for any other purpose.

Magazine Marketplace, MagazineMarketplace.co.uk and our logos are trade names or trade marks of Magazine Marketplace and may not be used by anyone else without our express permission.

However, Magazine Marketplace does not make any warranty or representation in respect of any other trade mark and the trade marks of the brands featured on MagazineMarketplace.co.uk belong to their respective owners.

Privacy and Data Policy

Magazine Marketplace makes a commitment to protect your privacy and promises only to use information collected about you in accordance with our Privacy Policy.

Disclaimer / Liability

Use of magazinemarketplace.co.uk is at your own risk. magazinemarketplace.co.uk is provided on an "as is" basis. To the maximum extent permitted by applicable law: (a) B Hannah disclaims all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to magazinemarketplace.co.uk; and (b) all implied warranties, terms and conditions relating to magazinemarketplace.co.uk (whether implied by statute, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non infringement, information accuracy, interoperability, quiet enjoyment and title are, as between B Hannah and you, hereby excluded. In particular, but without prejudice to the foregoing, we accept no responsibility for any technical failure of the internet and/ or magazinemarketplace.co.uk; or any damage or injury to users or their equipment as a result of or relating to their use of magazinemarketplace.co.uk. Your statutory rights are not affected.

To the full extent allowed by applicable law, you agree that we will not be liable to you/or any third party for any consequential or incidental damages (including but not limited to loss of revenue, loss of profits, loss of contracts, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to magazinemarketplace.co.uk

If B Hannah Ltd is liable to you directly or indirectly in relation to magazinemarketplace.co.uk, that liability (howsoever arising) shall be limited to fifty pounds sterling (£50.00).

Nothing in these terms shall be construed as excluding or limiting the liability of B Hannah or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by English law.

Access restriction and service suspension or termination

B Hannah Ltd reserves the right to suspend or cease providing all or any of the services currently available through magazinemarketplace.co.uk with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.
